CONDITIONS OF USE

Hearth and Grill Sales, LLC provides services to you subject to the following conditions. If you visit or shop at Hearthsidedistributors.com, you accept these conditions. Please read them carefully.

 

YOUR ACCOUNT

If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. Hearthsidedistributors.com does sell products for children, but it sells them to adults, who can purchase with a credit card. If you are under 18, you may use Hearthsidedistributors.com only with involvement of a parent or guardian. Hearthsidedistributors.com reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.

 

ELECTRONIC COMMUNICATIONS

When you visit Hearthsidedistributors.com or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

 

SHIPPING

The shipping charges calculated by this web site are for residents of the United States, excluding Hawaii and Alaska residents. Residents in Hawaii or Alaska must call for a freight quote before ordering.

 

RISK OF LOSS OR DAMAGE

UPS Ground Orders:  Hearth and Grill Sales, LLC is responsible for all damage on UPS Ground orders.   Shipping insurance is included at no charge on all items that ship UPS Ground.

Freight Truck: Hearth and Grill Sales, LLC offers shipping insurance coverage on all orders (for additional fee) placed by phone or on our web site.  Hearth and Grill Sales, LLC is responsible for all shortage and damage claims on insured orders.   All claims must be submitted within 48 hours of delivery of product. 

On orders that use the Freight Truck method of delivery and insurance coverage is declined by the purchaser, risk of loss or damage and title for such items pass to you (purchaser) upon our delivery to the carrier. Hearth and Grill Sales, LLC is not liable for shortage or damage on uninsured Freight Truck orders. If you receive damaged merchandise and need to file a claim, please contact  customer support and we will be happy to provide the claims forms required to file a claim with the carrier. 

 

RETURNS

You may return items sold by Hearthsidedistributors.com within 30 days of delivery. There will be a 20% re-stocking fee on all returned items. All items returned must be shipped by the same shipping company that was used to deliver your product. This policy also applies to products that are refused upon delivery. We pay the return shipping cost and wave the re-stocking fee if the return is a result of our error.

 

We cannot accept returns of certain items, including:

Any item that is returned more than 30 days after delivery.

Any item that is returned without prior authorization. 

Any item that has been installed or is not in the original carton.

Any item that is not in its original condition, is damaged, or is missing parts.

Any special made to order products such as Elmira Stove and Heartland Stove products.

 

Cancellation Fee

A 10% cancellation fee will be assessed on all cancelled orders or on any portion of an order that is cancelled before the order ships.  If a product ships prior to cancellation, the customer is responsible for shipping charges outbound and inbound as well as the restock fee covered in the previous paragraph.   Shipping charges and the restock fee will be deducted from credit due when the product is delivered to our location by the freight carrier.

 

Defective Merchandise 

Merchandise that becomes defective within the warranty period will be subject to the manufacturers warranty terms and conditions. In most cases, we will provide replacement parts to the customer. It is sometimes necessary to bill for all replacement parts and units and then credit once the defective or damaged items are returned to us. In most cases, defective merchandise is returned directly to the manufacturer and we issue credit to our customer when the manufacturer issues credit to us. This process can take up to 3 to 4 weeks. Hearthside will pay the shipping cost on all warranty parts for up to 30 days. After 30 days, the shipping cost on defective parts and units will be the responsibility of the customer as the manufacturers warranty does not cover shipping. All replacement parts and products will be billed to the credit card used to make the initial purchase. We will credit the card once the defective or damaged products are returned.

 

Sales Tax

Orders shipping to any Tennessee address will have sales tax added to the order. Orders shipping to states other than Tennessee are tax exempt.

 

Local Codes and Regulations

It is the consumer’s responsibility to research and know if the products sold on our web site can be used in your local area. We are not responsible for items that are purchased that cannot be used due to codes or restrictions. These items can be returned but would be subject to the return rules and regulations above.

 

Errors on Our Web site

We make every effort to ensure that the information on Hearthsidedistributors.com is accurate, complete and current. Despite our efforts, there may be instances when information about a Product contains inaccurate or incomplete data, including data about the Product's price or availability. Hearth and Grill Sales, LLC makes no warranty or guarantee that the information on Hearthsidedistributors.com is error-free, complete, or current. We reserve the right to correct errors and/or update the content on Hearthsidedistributors.com at any time without notice. Hearth and Grill Sales, LLC also reserves the right to refuse or cancel any order containing any error or inaccuracy, including after the order has been submitted, whether or not the order has been confirmed and your credit card charged. If your order is canceled after your payment has been processed, we will issue a full refund to the original pay type.

Collections

A 30% collection fee will be added to all accounts that are found to be uncollectable and forwarded to our attorney.   This will also apply to purchases made with invalid credit cards or credit card stop payments that do not comply to our terms and conditions.

 

SITE POLICIES, MODIFICATION, AND SEVERABILITY

These policies govern your visit to Hearthsidedistributors.com. We reserve the right to make changes to our site, policies, and these Conditions of Use at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining conditions.
